Article 1 : The present general conditions of the seasonal rental contract have as object to establish clearly the terms of rent between the owner and the tenant for the specified period.
Article 2 - length of stay : The tenant signatory to this contract concluded for a fixed period may not under any circumstances claim any right to remain in the premises at the end of the stay. Article 3 - conclusion of the contract : The reservation becomes effective once the lessee has sent the owner a deposit of 30% of the total rental amount and a copy of the contract signed before the date indicated on the front, a copy of the contract signed with the general conditions of the seasonal rental conditions and a photocopy of his valid identity card/passport. A second copy must be kept by the tenant. The lease entered into between the parties to this act may in no case benefit, even partially, third parties, natural or legal persons, unless the owner agrees in writing. Any infringement of the latter subparagraph would be liable to terminate the lease immediately to the tenant’s damage, the proceeds of the lease remaining definitively acquired by the landlord. No dispute concerning the price of the stay may be taken into account after the signing of the contract. It is the lessee’s responsibility to assess whether the price suits him or her before signing.
Article 4 - no withdrawal : For reservations made by e-mail, the tenant does not benefit from the withdrawal period, in accordance with article L121-20-4 of the Consumer Code, concerning accommodation provided on a date or according to a specified frequency.
Article 5 - cancellation by the tenant : Any cancellation must be notified by registered letter to the owner. (a) cancellation before arrival on the premises : If the cancellation occurs less than 30 days before the arrival date, the deposit remains acquired by the owner. He may request the balance of the stay if the cancellation occurs less than 8 days before the date of entry into the premises. If the lessee does not appear within 24 hours of the date of arrival indicated on the contract, this contract becomes null and void and the owner may dispose of his house. The advance payment also remains with the owner who will request payment of the balance of the lease. (b) if the stay is shortened, the rental price remains with the owner. No reimbursement will be made.
Article 6 - cancellation by the owner : The owner pays the tenant the full payment.
Article 7 – arrival/departure : The lessee must present himself at the date and time specified in the contract. In the event of late or delayed arrival, the tenant must notify the owner. The dwelling must be returned on the day and time indicated in the contract.
Article 8 - payment of the balance : The balance of the lease is paid 7 days before the start of the rental by bank transfer or in cash on arrival by the tenant.
Article 9 - condition : The accommodation is rented furnished and equipped as indicated in the attached inventory. Thisinventoryis drawn up jointly and signed by the lessee and the landlord or his representative on arrival at the list. Theinventoryis the only reference in the event of a dispute concerning the state of play. The condition of the house on arrival of the tenant must be noted in theinventory. The cleaning of the premises shall be the responsibility of the tenant during the rental period and before his departure. The billing of cleaning costs is established on the basis mentioned in theratessectionof the site. Article 10 - security deposit or surety : Before arrival, a deposit of EUR 200 will be paid to the landlord by bank transfer or cash on the day of arrival. Failure to pay will result in a refusal to enter the premises. After the contradictory establishment of the stage of exit, and if no damage is reported within 24 hours of the tenant’s departure, the deposit is returned by bank transfer within a maximum of 7 days, deduction of the cost of repair of the premises if damage is found. In the event of early departure (before the time mentioned in this contract) preventing the establishment of the inventory on the same day of the tenant’s departure, the deposit will be returned by bank transfer within a maximum period of 7 days, deduction of the cost of repairing the premises if damage is found. The lessee will be liable for all costs related to damage, loss of property or excessive wear during the rental period. In addition, the lessee shall be liable for any damage caused by him or his companions, whether intentional or negligent.
Article 11 - use of premises : The lessee must ensure the peaceful nature of the rental and use it in accordance with the destination of the premises. Gathers and celebrations are not allowed. Children are the exclusive responsibility of their parents or companions. Smoking and vaping inside the cottage are prohibited. Butts or ashes should not be thrown onto the terrace and around the cottage. Article 12 - capacity : This contract is established for a maximum capacity of persons (5). If the number of tenants exceeds capacity, the landlord may refuse additional persons. Any modification or termination of the contract will be taken into account at the initiative of the customer. The number of persons occupying the accommodation and their identity will be specified when requesting a reservation.
Article 13 – pets : Pets are not allowed in the dwelling. In the event of non-compliance with this clause, the owner may refuse the stay: no refund will be made. Article 14 - insurance : The lessee is liable for all damage occurring. He is obliged to be insured by a standard sailing insurance contract for these various risks. Failure to obtain insurance in the event of a claim will lead to damage. The owner undertakes to insure the dwelling against rental risks. The tenant must inform the owner within 24 hours of any claim in the dwelling, outbuildings or accessories. Article 15 - payment of additional charges : The rental price is inclusive of all charges (electricity 40 kWh/day, wifi). Any overconsumption, which will be recorded by a statement on arrival and departure from the tenant, will give rise to a billing on the basis of the calculation mentioned in theinventory. A justification is given by the landlord to the tenant. Article 16 - disputes : Claims relating to the leased property must be made within 48 hours of entry into the premises by registered letter to the owner, together with all the necessary documents. No claims will be taken into account after this period. Any dispute relating to the contract will be resolved only by the courts of the place of the rented building.
Pets
Pets or other animals are not accepted in the accommodation. In the event of non-compliance with this clause by the tenant, the owner may refuse the stay. In this case, no refund will be made.
Celebration and social gatherings
Celebration and social gatherings are not allowed.
Non-smoking gite
Smoking and vaping are not allowed inside the accomodation .Please do not leave cigarette butts or ashes on the terrace and around the gite.
Charges, household waste and recycling
Water, electricity and heating are included in the rental price. However, excessive consumption may be charged back to you. Please turn off the lights when you leave the accommodation and respect the environment. Selective sorting is organized : bins with specific sorting bags as well as a composter are available.
Capacity
The rental contract is established for a maximum capacity of people (5) which cannot under any circumstances be exceeded. If the number of tenants exceeds the accommodation capacity, the owner may refuse the additional people. Any modification or termination of the contract will be considered on the initiative of the customer.
Noise/Know how to live
The tenant must ensure the peaceful nature of the rental and use it in accordance with the purpose of the premises. Children are under the sole and complete responsibility of their parents or persons accompanying them. The furniture and equipment provided must be respected.
